Terms and Conditions of Use

Welcome to Moments. By downloading, accessing, or using the Moments application (“Application” or “App”), you agree to these Terms and Conditions (“Terms”) and to our Privacy Policy. Please read them carefully before using the App.

Moments is a private collaborative album application for events, developed by Matheus Domingues.

If you do not agree to these Terms, do not use the Application.

1. License to use

Moments is licensed, not sold, to you. We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the App on devices that you own or control, in accordance with the rules of the applicable app store (App Store or Google Play).

You may not copy, modify, distribute, sell, rent, or sublicense the App, nor reverse engineer it, except where expressly permitted by law.

2. What Moments is

Moments brings together photos and videos from a special moment in a single shared and private album. It is not a public social network: there is no open feed, followers, or exposure of content to people who do not participate in the event.

The organizer creates the event and invites other people. Participants contribute their records, forming a collective memory of the same moment.

3. Features

Moments allows, among other things:

• Create an account and manage a profile (name, email, time zone, and language)
• Create private events (birthdays, weddings, graduations, trips, baby showers, parties, and other moments)
• Set dates, time zone, event type, and cover
• Invite participants using a unique invitation code
• Join other people's events using the invitation code
• Capture photos and videos using the camera or choose images from the device's album
• Upload media to the event's collaborative album, within the limits defined by the organizer
• Control when media can be viewed (reveal during the event, after the event, or manually)
• Allow or prevent participants from viewing media before the reveal
• Like media, save copies to the device's album, and delete media that you uploaded
• Delete events that you created and delete your own account

Some features may evolve over time. Authentication features (such as Sign in with Apple) and paid plans, if offered, will be described in the App and in these Terms when they become available.

Moments is a service for organizing and preserving memories. We do not provide legal advice, nor do we guarantee that uploaded content is complete, authentic, or free from third-party rights.

4. Account and eligibility

To use the App, you must create an account, generally with an email and password. When available, you may also authenticate through providers such as Apple.

You agree to:

• Provide true, complete, and up-to-date information
• Maintain the confidentiality of your password and session
• Not share your account with other people
• Notify us if you suspect unauthorized use

You must be at least 13 years old. If you are under 18 years old, use the App with the authorization and supervision of a parent or guardian. Moments is not intended for children under 13 years old.

5. Events, invitations, and user content

5.1 Organizer and participants

The organizer (event owner) creates the event, defines rules (upload limits, reveal, cover), and shares the invitation code. Participants join using this code and may upload photos and videos, subject to the event settings.

Anyone who has the code may try to join the event. The organizer is responsible for sharing the invitation only with people they trust.

5.2 Content you upload

By uploading photos, videos, covers, event names, or any other content (“User Content”), you represent that:

• You have the necessary rights or authorization to upload it
• The content does not violate the law, image rights, privacy, intellectual property, or these Terms
• If the content depicts other people — including children — you have obtained the appropriate authorizations

You remain the owner of your User Content. To operate the service, you grant us a worldwide, non-exclusive, royalty-free license limited to hosting, storing, processing, transcoding, generating thumbnails, and displaying this content only to the authorized people of that event (organizer and participants), for the time necessary to provide the service.

5.3 Reveal

The reveal is an experience feature: media may remain hidden from participants until the time defined by the organizer. This does not prevent the organizer from viewing the content, nor does it prevent participants with later access from saving, sharing, or reproducing the media outside the App.

5.4 Moderation and removal

We may refuse, remove, or restrict content or accounts that violate these Terms, the law, or third-party rights, including as a result of a report or an order from a competent authority. The organizer may delete the event. You may delete media that you uploaded, subject to the App's rules.

Deleting your account removes your profile, the events you created, and the data associated with those events. Media that you uploaded to other people's events may be removed or disassociated from your identity, according to the technical operation of the service.

6. Prohibited conduct

It is prohibited to use Moments for:

• Illegal, fraudulent, abusive activities, or activities that harm third parties
• Uploading content that exploits, abuses, or sexually depicts children or adolescents
• Harassment, hate speech, violence, or improper exposure of third parties
• Accessing accounts, events, or systems without authorization, or attempting to circumvent access limits, reveal settings, or quotas
• Sharing invitation codes publicly or on a large scale for the purpose of exposing a private event
• Reverse engineering, abusive scraping, or overloading the infrastructure
• Using the App for unauthorized commercial purposes, spam, or unsolicited advertising

We reserve the right to suspend or terminate access in the event of a violation.

7. Device permissions

To function, the App may request access to:

• Camera, to capture photos and videos from the event
• Microphone, to record videos with audio
• Photo album / library, to choose images and save moments to the device

These permissions are optional within the operating system, but some features will not work without them. The processing of data obtained through these permissions is described in the Privacy Policy.

8. Personal data and LGPD

The processing of personal data complies with the Brazilian General Data Protection Law (Law No. 13,709/2018 — LGPD) and our Privacy Policy, which forms part of these Terms.

In summary, we process data to create your account, operate events and albums, authenticate access, store and deliver media to authorized participants, provide support, and comply with legal obligations.

You may exercise your data subject rights (access, correction, deletion, portability, information, and objection, among others) through the channels indicated in the Privacy Policy or in the App itself (including account deletion under Security).

9. Third-party services

Moments relies on providers for authentication, database services, storage, and delivery of photos and videos (for example, cloud infrastructure and CDN). The use of these services is subject to their respective policies. We do not control websites, apps, or external destinations that you access on your own.

Currently, the App does not display third-party ads (such as AdMob) and does not offer a paid subscription. If this changes, we will update these Terms and the Privacy Policy before enabling the feature.

10. Intellectual property

The App, the Moments brand, the code, design, text, and other elements of the service are owned by us or licensed to us. These Terms do not transfer any intellectual property rights, except for the license to use described in Section 1.

User Content remains owned by the person who uploaded it, subject to the license in Section 5.2 and the image rights of the people depicted.

11. Disclaimer of warranties

Moments is provided “as is”, to the extent permitted by Brazilian law, including the Brazilian Consumer Protection Code.

We make efforts to keep the App secure and available, but we do not guarantee uninterrupted or error-free operation, nor that photos and videos will be preserved forever. Network, device, or infrastructure provider failures may affect uploads, reveal, and playback.

12. Limitation of liability

To the maximum extent permitted by applicable law:

• We are not responsible for damages resulting from content uploaded by users, invitations shared improperly, or use of the App in violation of these Terms
• We are not responsible for loss of files on the device, for copies of media made by participants after the reveal, or for temporary unavailability
• Our liability, when applicable, is limited to proven direct damages, excluding lost profits and indirect damages, unless otherwise provided by law (including cases of intent or gross negligence)

Nothing in these Terms excludes non-waivable consumer rights.

13. Termination

You may stop using the App at any time and delete your account in the Security settings.

We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the service. In the event of discontinuation, we will seek to provide reasonable advance notice when possible.

14. Changes to these Terms

We may update these Terms periodically. Relevant changes will be communicated in the App or by email. Continued use after such communication constitutes acceptance of the new version, except when the law requires specific consent.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, in particular the LGPD and the Brazilian Consumer Protection Code, when applicable.

The courts of the consumer user's place of residence shall have jurisdiction, or, in the absence of a consumer relationship, the courts of the Developer's district shall have jurisdiction to resolve disputes.
